Application for Approval as an Excess and Surplus Lines Insurance Company

Foreign-domiciled insurance companies (i.e. risk-bearing entities) desiring to write insurance in Ohio on a non-admitted excess and surplus lines basis must first obtain written approval from the Department as required by subdivision (A) of Section 3905.33 of the Ohio Revised Code. Ohio has no “seasoning requirements.” No fees are due with the application.

Approved non-admitted excess and surplus lines insurance companies are not “authorized” or “licensed” insurance companies and are not approved to write insurance in Ohio other than on an excess and surplus lines basis. Please see Application for Approval to Write Excess and Surplus Lines Insurance in Ohio for instructions regarding filing the application. Approval for alien insurance companies is accomplished through the National Association of Insurance Commissioners (NAIC) by inclusion in the NAIC publication Quarterly Listing of Alien Insurers.

To obtain licensure as an admitted, authorized insurance company in Ohio, please see the Application for Licensure as an Admitted Insurer.
