Medical Liability Data Collection

Ohio Revised Code 3929.302 requires medical liability providers to report closed claims data.  Ohio Administrative Code 3901-1-64 outlines the procedures and reporting requirements.

The rule requires that each authorized insurer, surplus lines insurer, risk retention group and self insurer report the costs of defending medical liability claims, as well as the costs of paying judgments or settlements on behalf of the health care provider or health care entity.

The rule requires that the closed claims data for the previous calendar year be reported by May 1.  

The closed claims data must be submitted through the Medical Liability Data Collection Application, a secured application on the department's website.  Familiarity with the user guide is imperative before attempting to submit any closed claims data.
